Terms of Service
These terms govern use of BryskBits services, including dedicated servers, bandwidth services, support, and related infrastructure.
These Terms of Service apply to the person or organization ordering or using BryskBits services. The final contracting entity, governing law, and service-specific terms must be confirmed in the executed order, invoice, or master service agreement before publication as binding legal terms.
1. Definitions
“Services” means dedicated servers, bandwidth pools, network services, remote management access, support, and related infrastructure supplied by BryskBits. “Customer Content” means content, data, streams, files, software, traffic, and instructions hosted, transmitted, stored, or processed through the Services. “Authorized Users” are people you permit to access or administer the Services.
2. Services
BryskBits provides high-bandwidth infrastructure for lawful streaming, media, CDN origin, IPTV, bandwidth pooling, and custom workloads. Product pages describe public configurations, but the final service scope, availability, pricing, tax treatment, IP allocation, support level, delivery model, and optional services are controlled by the written order.
BryskBits may use datacenter, carrier, payment, software, support, or operational suppliers to provide the Services. Third-party services remain subject to their own terms where applicable.
3. Eligibility and account responsibility
You must be legally able to enter into a binding contract. You are responsible for account information, authorized users, credentials, server access, API keys, SSH keys, IPMI/KVM access, billing contacts, and all activity originating from your Services, including activity caused by compromised applications or weak credentials where you are responsible for securing them.
4. Customer content and acceptable use
You are solely responsible for Customer Content and for having all rights, licenses, permissions, and legal authority needed to host, store, transmit, stream, or distribute it. Your use must comply with the Acceptable Use Policy and all applicable laws. Privacy-oriented infrastructure supports lawful privacy; it does not permit copyright infringement, malware, fraud, spam, phishing, unauthorized streaming, or network abuse.
5. Payments, renewals, cancellation and chargebacks
Unless the written order states otherwise, fees are billed in advance and renew automatically for the selected term. You are responsible for invoices, taxes, payment-provider fees, setup fees, usage-based charges where agreed, and custom work. Non-payment, failed renewal, fraudulent payment, or abusive chargeback may result in suspension or termination. Cancellation and refund eligibility are governed by the Refund Policy and the written order.
6. IP addresses, bandwidth and fair use
IP addresses are allocated for use with the Services and are not sold to you. BryskBits may renumber, withdraw, route, suspend, or reclaim IP resources when required by law, registry policy, network stability, abuse handling, non-payment, or service termination. Additional IPs, BGP, private VLANs, and custom routing require written approval.
“Unmetered” means the public plan is not billed by per-gigabyte transfer volume. It does not remove technical limits, port limits, agreed fair-use terms, abuse controls, maintenance, or lawful restrictions. Bandwidth Pool services are governed by the written quote, including eligible servers, measurement windows, upgrade paths, alerting, and overage handling.
7. Hardware, remote management, software and backups
Hardware specifications are confirmed in the order. Equivalent substitutions may be used where performance and service scope remain materially comparable. Remote management tools such as IPMI or KVM are provided where available and must be secured by the customer. You are responsible for software licensing, operating system security, application patching, content licensing, and backups unless a written managed or backup service states otherwise.
Data loss can occur through hardware failure, customer error, security incidents, abuse action, suspension, termination, or force majeure. Maintain independent backups for any data you cannot afford to lose.
8. Support, availability and SLA relationship
Support covers the service scope stated in the order. Self-managed servers remain the customer's responsibility at the operating system and application layer. Any availability target, hardware replacement target, response target, or credit schedule must be stated in the SLA or written order to be binding.
9. Privacy, monitoring, abuse and legal requests
BryskBits does not routinely inspect, screen, or monitor customer content or traffic solely for the purpose of determining legality. BryskBits may investigate, access, preserve, suspend, remove, rate-limit, filter, or disclose information when responding to credible abuse reports, protecting the network, enforcing terms, investigating security incidents, complying with applicable law, or responding to legally valid requests or orders.
10. Suspension and termination
BryskBits may suspend or terminate Services for non-payment, abuse, security risk, legal requirement, violation of these Terms, violation of the AUP, excessive risk to the network, or failure to respond to abuse notices. Emergency suspension may occur without advance notice where needed to protect users, third parties, or the network. On termination, data may be deleted according to operational policy and legal requirements.
11. Indemnity, disclaimers and liability
You agree to indemnify BryskBits from claims, losses, damages, penalties, and expenses arising from Customer Content, your use of the Services, your users, your breach of these Terms, infringement claims, or unlawful activity. Services are provided on an “as is” and “as available” basis except for express written commitments. To the maximum extent permitted by law, BryskBits is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. Aggregate liability is limited to fees paid for the affected Service during the month before the event giving rise to the claim, unless applicable law requires otherwise.
12. General terms and policy updates
BryskBits is not responsible for delay or failure caused by events beyond reasonable control, including carrier outages, datacenter incidents, fiber cuts, attacks, labor disputes, power events, regulatory action, or natural disasters. If any provision is unenforceable, the rest remains effective. Policies may be updated from time to time; material changes should be communicated through the website, account notice, or email.
13. Contact
Use the Contact page for service questions and the Report Abuse page for abuse notices. Public email addresses and legal entity details should be inserted only after the business confirms the approved contact channels and contracting entity.
These public policies are drafted for publication clarity and operational alignment. Final publication should be reviewed by qualified counsel for the actual company jurisdiction and contracting entity.
